These Terms and Conditions (“Terms”) govern your access to and use of the website, products, content, checkout process, account features, communications, and related services offered by NYC Peptide Labs (“NYC Peptide Labs,” “Company,” “we,” “us,” or “our”) through nycpeptidelabs.com and any related pages or services controlled by us (collectively, the “Site”).

By accessing the Site, creating an account, placing an order, submitting payment information, or otherwise using our services, you agree to be bound by these Terms, our Privacy Policy, our Return Policy, our Shipping Policy, and our Research Use Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not access the Site, create an account, or purchase any product from us.

  1. Eligibility

You must be at least twenty-one (21) years old to access this Site or purchase products from NYC Peptide Labs.

By using the Site or placing an order, you represent and warrant that:

(a) you are at least twenty-one (21) years old;

(b) you are legally capable of entering into a binding agreement;

(c) you are purchasing strictly for lawful laboratory research purposes;

(d) you are a qualified research purchaser, research entity, laboratory, scientific professional, or authorized representative of a qualified research organization;

(e) you are not purchasing for personal use, human use, veterinary use, diagnostic use, therapeutic use, food use, cosmetic use, household use, bodybuilding use, athletic-performance use, weight-management use, or any other non-research use;

(f) you will comply with all applicable federal, state, local, and international laws, rules, and regulations relating to the purchase, possession, storage, handling, transport, use, and disposal of the products; and

(g) all information you provide to us is accurate, complete, and current.

We reserve the right to refuse service, cancel orders, restrict account access, request additional verification, or decline to sell products to any person or entity for any reason, including suspected non-research use, suspected misuse, suspected diversion, inaccurate information, prohibited claims, or failure to satisfy our qualification requirements.

  1. Research Qualification Verification

Before purchasing products from NYC Peptide Labs, you must certify that you are purchasing strictly for laboratory research use only.

You represent and warrant that you fall within at least one of the following categories:

(a) academic researcher, including university-affiliated research personnel;

(b) registered laboratory or research facility;

(c) biotechnology, pharmaceutical, or life-sciences company;

(d) contract research organization;

(e) government, regulatory, or institutional research entity;

(f) industrial or commercial research and development department;

(g) scientific professional operating within a controlled laboratory environment; or

(h) qualified independent researcher operating within a lawful, controlled, non-clinical laboratory setting.

You further represent and warrant that:

(a) you are purchasing on behalf of a legitimate research entity, laboratory, or qualified research environment;

(b) the products will be used strictly for lawful laboratory research purposes;

(c) the products will not be used in or on humans or animals;

(d) the products will not be consumed, ingested, injected, administered, implanted, inhaled, compounded for use, incorporated into foods, supplements, cosmetics, drugs, medical devices, or veterinary products, or otherwise used outside a controlled research setting;

(e) the products will not be used for diagnosis, treatment, cure, mitigation, prevention, or management of any disease, condition, symptom, injury, disorder, or physiological state;

(f) you possess or will obtain all training, equipment, facilities, licenses, authorizations, procedures, and safeguards necessary to lawfully and safely receive, store, handle, use, and dispose of the products; and

(g) you understand that any misuse, diversion, resale, redistribution, human use, animal use, or non-research use violates these Terms and may violate applicable law.

  1. Research Use Only

All products sold by NYC Peptide Labs are offered strictly for laboratory research use only. Products are not drugs, medicines, biologics for clinical use, dietary supplements, foods, cosmetics, medical devices, consumer products, or veterinary products.

Products are not intended for human consumption, animal consumption, human administration, animal administration, diagnostic use, therapeutic use, clinical use, food use, cosmetic use, household use, personal use, resale for personal use, or any use inconsistent with laboratory research.

No product offered by NYC Peptide Labs is intended to diagnose, treat, cure, mitigate, prevent, or manage any disease, condition, symptom, injury, disorder, or physiological state. No statement on the Site should be interpreted as a medical, therapeutic, veterinary, diagnostic, dosing, treatment, safety, efficacy, or human-use claim.

  1. No Medical, Veterinary, or Professional Advice

The Site may contain product names, product descriptions, molecular information, general scientific references, handling information, storage information, specifications, testing information, or other research-oriented content. Such content is provided for informational and commercial catalog purposes only and is not medical advice, veterinary advice, diagnostic advice, treatment advice, dosing advice, compounding advice, regulatory advice, legal advice, or professional advice.

You should not rely on any information on the Site for decisions involving human health, animal health, diagnosis, treatment, dosing, administration, consumption, compounding, or clinical application. We do not provide and will not provide instructions, protocols, dosing information, administration information, reconstitution instructions for human or animal use, or guidance concerning human or animal use.

Any request for human-use, animal-use, dosing, administration, treatment, injection, compounding, bodybuilding, athletic-performance, cosmetic, weight-management, anti-aging, or therapeutic guidance may result in order cancellation, account restriction, or refusal of service.

  1. Customer Responsibilities

You are solely responsible for determining whether any product is suitable and lawful for your intended research purpose.

By purchasing from NYC Peptide Labs, you agree that you are solely responsible for:

(a) verifying the legality of purchasing, possessing, storing, handling, using, transporting, and disposing of the products in your jurisdiction;

(b) maintaining appropriate laboratory facilities, protocols, training, equipment, storage conditions, safety procedures, and disposal procedures;

(c) reviewing all applicable safety information, specifications, certificates of analysis, labels, and documentation;

(d) ensuring that all personnel who may handle the products are qualified, trained, and properly supervised;

(e) complying with all applicable laws, regulations, institutional rules, biosafety requirements, chemical hygiene requirements, and occupational safety requirements;

(f) preventing unauthorized access, misuse, diversion, resale, redistribution, human use, animal use, or non-research use; and

(g) warning all relevant persons of any hazards associated with handling, storing, or using the products.

  1. Prohibited Uses

You may not use, purchase, possess, store, handle, transfer, resell, redistribute, advertise, or otherwise deal with any product from NYC Peptide Labs for any prohibited purpose, including:

(a) human consumption or administration;

(b) animal consumption or administration;

(c) injection, ingestion, inhalation, implantation, topical use, or other application to or in a human or animal;

(d) diagnosis, treatment, cure, mitigation, prevention, or management of any disease, condition, symptom, injury, disorder, or physiological state;

(e) use as or in a drug, medicine, biologic for clinical use, dietary supplement, food, cosmetic, medical device, veterinary product, household product, or consumer product;

(f) compounding, manufacturing, packaging, repackaging, labeling, or relabeling for human or veterinary use;

(g) bodybuilding, athletic-performance, anti-aging, weight-management, wellness, personal experimentation, or similar non-research use;

(h) resale, redistribution, transfer, or export in violation of these Terms or applicable law;

(i) any use inconsistent with the product label, documentation, or Research Use Policy; or

(j) any unlawful purpose.

  1. Product Information, Specifications, and Certificates of Analysis

We may provide product descriptions, specifications, purity information, batch or lot information, certificates of analysis, third-party testing links, or related documentation. This information is provided for research-catalog purposes only.

We make reasonable efforts to present accurate information, but we do not warrant that product descriptions, images, specifications, pricing, availability, testing information, batch information, or other Site content is complete, current, error-free, or suitable for any particular purpose.

Certificates of Analysis listed on the website are sourced from our vendors and/or third parties. NYC Peptide Labs does not guarantee products sold come from these tested batches. Certificates of analysis are provided for informational purposes only and do not constitute a guarantee of suitability for any particular research purpose. You are responsible for independently verifying suitability, identity, purity, safety, and compliance for your intended lawful research use.

Product characteristics may vary by batch, lot, supplier, testing method, storage condition, transport condition, or other factors. Images are for illustrative purposes only and do not represent the actual product, packaging, color, appearance, fill level, label, or batch received.

  1. Orders and Acceptance

Placing an order does not guarantee acceptance of the order. All orders are subject to review, verification, availability, payment authorization, qualification review, compliance review, and our acceptance.

We reserve the right, in our sole discretion, to accept, reject, cancel, limit, hold, delay, or request additional information for any order for any reason, including suspected non-research use, suspected diversion, inaccurate information, payment issues, product unavailability, shipping restrictions, compliance concerns, or violation of these Terms.

If we cancel an order after payment has been captured, we will issue a refund to the original payment method unless prohibited by law or payment-network rules.

  1. Pricing, Payment, and Taxes

Prices are listed in U.S. dollars unless otherwise stated. Prices, availability, shipping costs, taxes, discounts, and promotions may change without notice.

You agree to provide accurate billing, shipping, contact, and payment information. You authorize us and our payment service providers to process your payment and perform related fraud-prevention, compliance, and verification checks.

You are responsible for all applicable sales, use, excise, import, export, customs, duties, fees, or other taxes or charges associated with your purchase, except taxes based on our income.

We do not store full payment-card details unless expressly stated by the payment provider. Payment processing may be performed by third-party processors subject to their own terms and policies.

  1. Shipping, Delivery, Risk of Loss, and Address Accuracy

Shipping options, costs, estimated delivery times, and restrictions are described in our Shipping Policy and during checkout. Delivery estimates are not guarantees.

You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, losses, returns, temperature exposure, failed delivery, delivery to an incorrect address, or other issues caused by inaccurate or incomplete shipping information, carrier error, weather, customs, regulatory inspection, recipient unavailability, or events outside our control.

Risk of loss transfers to the purchaser upon tender of the package to the carrier, except where applicable law provides otherwise. Title to products transfers upon shipment, subject to our right to cancel, recall, restrict, or refuse transactions where required or appropriate.

  1. Returns, Refunds, and Order Issues

Due to the specialized nature of our products, research-use restrictions, chain-of-custody concerns, storage concerns, contamination concerns, and safety considerations, all sales are final except as expressly provided in our Return Policy or required by applicable law.

We do not accept returns of opened, used, handled, stored, temperature-exposed, altered, relabeled, transferred, or otherwise compromised products.

If your order arrives damaged, incomplete, incorrect, or materially different from what you ordered, you must contact us within 7 days of delivery at support@nycpeptidelabs.com with your order number, photographs, packaging information, and any relevant details. Failure to notify us within the stated period may waive your ability to request replacement, correction, or refund.

Refunds, replacements, store credits, or other remedies are provided at our discretion and subject to our Return Policy.

  1. No Resale, Redistribution, or Transfer

Unless we provide prior written authorization, products purchased from NYC Peptide Labs may not be resold, redistributed, transferred, repackaged, relabeled, exported, brokered, advertised, or supplied to any third party.

You may not remove, alter, obscure, or modify product labels, warnings, batch information, lot information, research-use statements, or documentation.

  1. Account Registration and Security

You may be required to create an account to access certain features or place orders. You agree to provide accurate, current, and complete information and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You must notify us immediately of any unauthorized access or suspected security breach.

We may suspend, restrict, or terminate accounts at any time for any reason, including suspected violation of these Terms, suspected misuse, suspected diversion, fraud risk, chargeback risk, or compliance concerns.

  1. Website Content and Intellectual Property

The Site and its content, including text, graphics, logos, product listings, images, design elements, layout, icons, software, data, and other materials, are owned by or licensed to NYC Peptide Labs and are protected by intellectual property laws.

You may access and use the Site only for lawful, personal, internal, and research-procurement purposes. You may not copy, reproduce, distribute, modify, scrape, crawl, frame, mirror, republish, create derivative works from, or commercially exploit any Site content without our prior written consent.

  1. User Conduct

You agree not to:

(a) use the Site for any unlawful, fraudulent, deceptive, abusive, or harmful purpose;

(b) submit false, misleading, incomplete, or unauthorized information;

(c) attempt to purchase products for prohibited use;

(d) request dosing, administration, injection, ingestion, therapeutic, veterinary, bodybuilding, performance, weight-management, cosmetic, anti-aging, or human-use guidance;

(e) interfere with Site security, functionality, or operation;

(f) attempt to gain unauthorized access to any system, account, database, or payment process;

(g) use automated means to scrape, copy, or harvest Site content; or

(h) engage in conduct that may expose NYC Peptide Labs, its vendors, payment processors, carriers, customers, or affiliates to legal, regulatory, financial, or reputational risk.

  1. Third-Party Links, Labs, Carriers, and Service Providers

The Site may contain links to third-party websites, laboratories, payment processors, shipping carriers, analytics providers, compliance vendors, or other service providers. Third-party sites and services are not controlled by us.

We are not responsible for the content, accuracy, availability, security, privacy practices, testing methods, results, policies, or conduct of third parties. Accessing third-party links or services is at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, PRODUCTS, CONTENT, DOCUMENTATION, CERTIFICATES OF ANALYSIS, TESTING INFORMATION, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

NYC PEPTIDE LABS DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SAFETY, STERILITY, QUALITY, PERFORMANCE, COMPLIANCE, OR SUITABILITY FOR ANY PARTICULAR RESEARCH PURPOSE.

WITHOUT LIMITING THE FOREGOING, NYC PEPTIDE LABS DOES NOT WARRANT THAT:

(a) ANY PRODUCT IS SUITABLE FOR ANY SPECIFIC RESEARCH PURPOSE;

(b) ANY PRODUCT IS STERILE, PYROGEN-FREE, ENDOTOXIN-FREE, OR SUITABLE FOR HUMAN OR ANIMAL USE;

(c) ANY PRODUCT HAS BEEN TESTED FOR SAFETY OR EFFICACY IN HUMANS OR ANIMALS;

(d) ANY PRODUCT MAY BE LAWFULLY PURCHASED, POSSESSED, USED, IMPORTED, EXPORTED, OR TRANSFERRED IN YOUR JURISDICTION;

(e) SITE CONTENT OR PRODUCT INFORMATION IS COMPLETE, CURRENT, OR ERROR-FREE; OR

(f) THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NYC PEPTIDE LABS AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SUPPLIERS, AFFILIATES, AGENTS, SERVICE PROVIDERS, PAYMENT PROCESSORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, PROCUREMENT OF SUBSTITUTE PRODUCTS, PERSONAL INJURY, PROPERTY DAMAGE, REGULATORY CONSEQUENCES, OR CLAIMS ARISING FROM MISUSE, DIVERSION, HANDLING, STORAGE, POSSESSION, TRANSFER, OR USE OF PRODUCTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, PRODUCTS, ORDERS, CONTENT, DOCUMENTATION, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO NYC PEPTIDE LABS FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

  1. Indemnification

You agree to indemnify, defend, and hold harmless NYC Peptide Labs and its owners, officers, directors, employees, contractors, suppliers, affiliates, agents, service providers, payment processors, and representatives from and against any claims, demands, actions, losses, damages, liabilities, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

(c) any misuse, unauthorized use, human use, animal use, diagnostic use, therapeutic use, personal use, or non-research use of any product;

(d) your violation of these Terms, the Research Use Policy, the Return Policy, the Shipping Policy, or the Privacy Policy;

(e) your violation of any applicable law, rule, regulation, institutional policy, or third-party right;

(f) false, inaccurate, incomplete, or misleading information provided by you;

(g) claims by any third party arising from your acts, omissions, research, personnel, facility, customers, recipients, or downstream users; or

(h) your negligence, willful misconduct, fraud, or unlawful conduct.

  1. Force Majeure

We shall not be liable for any delay, failure, loss, or damage resulting from events beyond our reasonable control, including acts of God, natural disasters, fire, flood, severe weather, epidemic, pandemic, war, terrorism, civil unrest, labor disputes, supply-chain disruption, carrier delays, customs delays, regulatory action, government restrictions, power outages, cyber incidents, payment-processor interruptions, or other circumstances beyond our control.

We may update, modify, suspend, or discontinue any part of the Site, products, prices, availability, content, policies, or these Terms at any time without prior notice.

  1. Dispute Resolution; Venue; Class Action Waiver

Before filing any legal action, you agree to contact us at support@nycpeptides.com and attempt to resolve the dispute informally. If the dispute is not resolved within thirty (30) days, either party may pursue available legal remedies.

Subject to applicable law, any claim or dispute arising out of or relating to these Terms, the Site, products, orders, or services shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction and venue of those courts.

To the maximum extent permitted by applicable law, you and NYC Peptide Labs agree that any dispute shall be brought only on an individual basis and not as a class action, collective action, consolidated action, representative action, or private attorney general action.

  1. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or modified to the minimum extent necessary to make it enforceable. The remaining provisions shall remain in full force and effect.

  1. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

  1. Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, restructuring, sale of assets, or transfer of business operations.

  1. Entire Agreement

These Terms, together with our Privacy Policy, Return Policy, Shipping Policy, Research Use Policy, and any checkout acknowledgments or order-specific terms, constitute the entire agreement between you and NYC Peptide Labs concerning your use of the Site and purchase of products.
